Unless otherwise agreed in writing, all original creative work produced by Why Not remains our intellectual property until full payment has been received. Upon final payment, clients receive the rights outlined in their project agreement. We reserve the right to showcase completed work in our portfolio, website, and promotional materials unless a confidentiality agreement states otherwise.
Payments
Payment terms are outlined in each project proposal or agreement. Projects may require an upfront deposit before work begins. Late payments may result in project delays, paused work, or additional fees. All payments are non-refundable unless otherwise stated in writing.
Limitation of Liability
To the fullest extent permitted by law, Why Not is not liable for indirect, incidental, or consequential damages arising from the use of our website or services, including but not limited to:
Project delays caused by missing client materials or approvals.
Third-party platform outages or service interruptions.
Actions or content provided by third-party vendors or collaborators.
Loss of business opportunities, revenue, or data beyond our reasonable control.
Project Termination
Either party may terminate a project in accordance with the terms outlined in the project agreement. Any completed work and outstanding invoices remain payable upon termination.

Our work may involve third-party platforms, software, or service providers. While we carefully select the tools we use, Why Not is not responsible for the policies, performance, or content of third-party services.
Changes to These Terms
